Enforcement Hearing

We Assist With Enforcement Hearing Proceedings in North Queensland

Helping Creditors & Debtors

Providing the Support You Need

Are you a creditor chasing a debtor for owed money? Are you still waiting to receive payment from the opposing party, even after they have been court ordered to make the payment by a certain date? We know how frustrating this process can be! At Vanguard Mercantile, we can help you fast-track the process to receive the funds you are entitled to. We provide enforcement hearing representation for clients all over North Queensland—including Townsville, as far south as Mackay and surrounds, to as far north as Cairns and surrounds.

So, how does it work? Well, if you’re owed money under a court order, you can apply to the Magistrates Court for an enforcement hearing. These hearings reveal financial information about the debtor who owes you money. Once the hearing is set, the debtor must fill out a statement regarding their finances, which gives the creditor information about the other party’s ability to pay the money they owe. The creditor can then launch enforcement proceedings within six years of the money order being made.

It can be very challenging for a creditor to learn about the amount of capital their debtor has at their disposal when they have refused to pay their debt. That’s where we come in. Sitting across the table from a debtor who owes you money can make the interview process hostile and emotive. Let our mercantile agents represent you at the hearing. They will manage the meeting in a professional manner without any emotional distraction.

What is an Enforcement Warrant?

An enforcement warrant is used to enforce money owed by a debtor to be paid to a creditor in court. Oftentimes—even after winning a civil case and being credited to receive a court ordered payment—debtors will still refuse to pay up to the creditor. Enforcement warrants can only be issued once a court judgement has been filed.

There are many types of enforcement warrants including:

  • Seizure & sale of property
  • Redirection of debt
  • Repossessions
  • Regular redirections from financial institutions
  • Redirection of earnings
  • Payment by instalments
  • Recovery of possession of land
  • Delivery of goods
  • Seizure & detention of property
